This End User License Agreement ("EULA") is a legal agreement between you ("User", "you") and BrandSentry Pro ("BrandSentry", "we", "us") governing your use of the BrandSentry Pro software, platform, monitoring agents, APIs, and related services (collectively, the "Software"). By creating an account, installing any agent, or using any part of the Software, you accept and agree to be bound by this EULA.
This EULA should be read alongside our Terms of Service.
1. License Grant
Subject to your compliance with this EULA and payment of any applicable fees, BrandSentry Pro grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to: access and use the BrandSentry Pro web platform through a supported browser; install and run the BrandSentry monitoring agent on servers and infrastructure that you own or are authorised to manage; and access the BrandSentry API to interact with your own account data, subject to applicable rate limits. This licence is granted solely for your internal business purposes.
2. Restrictions
You must not: copy, modify, or create derivative works of the Software; reverse engineer or decompile the Software; rent, resell, or sublicense the Software without our written consent; remove proprietary notices; use the Software to build a competing product; or use the Software in violation of applicable law.
3. Authorised Use of Monitoring and Scanning
By using the Software, you represent that you own or have explicit written authorisation to monitor every domain, server, URL, IP address, or system you configure. You consent to BrandSentry Pro running uptime checks, SSL certificate checks, domain expiry checks, port scans, server load probes, and any other current or future monitoring and scanning functions against the targets you configure. You will not configure the Software to monitor or scan third-party systems without their permission.
4. Monitoring Agent
The Agent may only be installed on servers you own or are authorised to manage. It transmits system metrics (CPU, memory, disk usage) to BrandSentry Pro servers solely to provide the monitoring service. You are responsible for ensuring installation complies with your hosting provider terms and data residency requirements.
5. API Access
API access is limited to reading and managing your own account data. You must not exceed published rate limits or embed API keys in publicly accessible code or repositories.
6. Intellectual Property
The Software and all underlying code, algorithms, and interfaces remain the exclusive property of BrandSentry Pro. You retain all rights to data you submit to the Software. You grant BrandSentry Pro a limited licence to process that data solely to provide the Software.
7. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE". BRANDSENTRY PRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND UNINTERRUPTED OPERATION.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDSENTRY PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
9. Indemnification
You agree to indemnify and hold harmless BrandSentry Pro from any claims arising from your use of the Software in violation of this EULA, your monitoring of unauthorised systems, or your violation of any third-party rights.
10. Term and Termination
This EULA is effective until terminated. It terminates automatically upon breach. Upon termination, all licences cease immediately and you must uninstall any Agent.
11. Amendments
We may amend this EULA with 14 days notice. Continued use after the effective date constitutes acceptance.
