Please read these Terms of Service ("Terms") carefully before using BrandSentry Pro ("BrandSentry", "we", "us") at brandsentrypro.com. By creating an account or using any part of the Service, you agree to be bound by these Terms.
1. Description of Service
BrandSentry Pro is a website and infrastructure monitoring platform providing: uptime monitoring, SSL certificate expiry monitoring, domain name expiry monitoring, system resource monitoring (CPU, memory, disk), public and private status pages, multi-location testing, API access and data export, team member access, and email notifications.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract. The Service is intended for business and professional use.
3. Account Registration
You must provide accurate and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately at ray@brandsentrypro.com if you suspect unauthorised access.
4. Team Members
Account owners may invite team members. You (the account owner) are solely responsible for your team members actions within the Service. Team members operate under the account owner active plan.
5. Subscription Plans and Billing
Subscriptions are billed monthly in USD. Payment is due at the start of each billing cycle. If payment fails, we may suspend or downgrade your account after 7 days. Prices are exclusive of applicable taxes. Upgrades take effect immediately; downgrades take effect at the next billing cycle.
6. Free Trial
Where a free trial is offered, it begins on activation and ends after the stated period. We reserve the right to limit free trials to one per person or organisation.
7. Cancellation and Refunds
You may cancel at any time from your account settings. Your plan remains active until the end of the current billing period. We do not offer refunds for partial months or unused time, except where required by law. Data may be permanently deleted 90 days after account closure.
8. Acceptable Use
You agree not to: monitor systems you do not own or have permission to monitor; conduct denial-of-service or stress testing against third-party systems; circumvent security features; scrape or redistribute our platform data; attempt unauthorised access; use the Service for any unlawful purpose; or resell the Service without a written agreement.
9. Intellectual Property
BrandSentry Pro, its software, algorithms, and trademarks are owned by or licensed to us. You receive only a limited, non-exclusive, non-transferable, revocable licence to use the Service as permitted by your plan. You retain ownership of data you submit to the Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRANDSENTRY PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
12. Indemnification
You agree to indemnify BrandSentry Pro from any claims arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
13. Modifications
We may modify these Terms with 14 days notice for material changes. Continued use after the effective date constitutes acceptance.
14. Termination
We may suspend or terminate your account immediately for breach of these Terms. All provisions that by nature should survive termination will survive.
15. Governing Law
These Terms are governed by applicable law. Disputes shall be resolved by binding arbitration or the courts in the jurisdiction where BrandSentry Pro operates.
